These Terms of Use (“Terms”) govern your use of ainextgentools.com (the “Site”), operated by Wayne Hunter trading as Designet (“AI Nextgen Tools”, “we”, “us”). By using the Site, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Site.
1. Who may use the Site
You must be at least 18 years old, or have the permission of a parent or guardian, to use the Site, submit a tool or join the newsletter.
2. What the Site provides
AI Nextgen Tools is a free directory that helps people discover artificial intelligence tools. We list, describe, categorise and highlight tools made by other companies. We do not make, sell or support those tools, and we are not party to any agreement between you and a tool provider.
3. Information only, no guarantees
Tool descriptions, categories, badges (such as “Recommend” or “Author’s Pick”), upvote counts and rankings are for general information and reflect our opinions or community activity. AI tools change quickly: features, pricing, availability and terms may differ from what the Site shows. Always check details on the provider’s own website before signing up or paying. Nothing on the Site is legal, financial, tax or professional advice.
4. Affiliate links
Some links on the Site, including links through ainextgentools.com/go/, are affiliate links. We may earn a commission if you sign up or buy through them, at no extra cost to you. See our Affiliate Disclosure.
5. Third-party tools and websites
When you follow a link to a third-party tool or website, you leave our Site and are governed by that provider’s terms and privacy policy. We are not responsible for third-party content, products, services, outputs, data practices, billing or support. Any dispute about a tool is between you and its provider.
6. Submitting a tool
By submitting a tool, you confirm that:
- the information is accurate and not misleading;
- you own or are authorised to represent the tool, or are recommending it in good faith;
- the tool is lawful and does not infringe anyone’s rights.
You grant us a free, worldwide, non-exclusive, perpetual licence to use, edit, publish and display the submitted information, together with the tool’s name, logo and screenshots, to operate and promote the Site. Submission does not guarantee a listing. We may edit, recategorise, reject or remove any listing at any time, and we may add our own affiliate link to a listed tool.
7. Upvotes and fair use
Upvotes are meant to reflect genuine interest. You may not use bots, scripts, multiple devices, VPNs, paid services or other means to inflate or manipulate votes. We may remove suspicious votes or listings without notice.
8. Acceptable use
You agree not to:
- use the Site for anything unlawful, fraudulent or harmful;
- scrape, copy or republish the directory, in whole or substantial part, by automated or manual means without our written permission;
- send spam, malware or abusive messages through our forms;
- interfere with the Site’s security or performance, or try to bypass reCAPTCHA or other protections;
- impersonate any person or company.
9. Intellectual property
The Site’s design, text we write, logo, and the selection and arrangement of the directory belong to us or our licensors and are protected by copyright and other laws. You may view and share links to pages for personal, non-commercial use. Tool names, logos and trademarks belong to their respective owners; showing them does not mean the owner endorses us or we endorse them.
10. Newsletter
If you subscribe, we will send you our newsletter about AI tools, which may contain affiliate links. You can unsubscribe at any time using the link in each email.
11. Disclaimer
To the extent permitted by law, the Site and its content are provided “as is” and “as available”, without warranties of any kind, express or implied, including accuracy, completeness, fitness for a particular purpose or uninterrupted availability.
12. Limitation of liability
To the extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, or for loss of data, profits or business, arising from your use of the Site or any third-party tool you find through it. Where liability cannot be excluded, our total liability to you is limited to ZAR 1,000 (or the equivalent in your currency). Nothing in these Terms limits any right you have under the South African Consumer Protection Act, 2008, or other laws that cannot be excluded by agreement, or our liability for gross negligence or wilful misconduct.
13. Indemnity
You agree to indemnify us against claims, losses and reasonable legal costs arising from your breach of these Terms, your submissions, or your misuse of the Site.
14. Suspension and changes to the Site
We may change, suspend or discontinue any part of the Site, or block access to anyone who breaches these Terms, at any time.
15. Changes to these Terms
We may update these Terms from time to time. The updated version takes effect when posted on this page with a new effective date. Continuing to use the Site after that means you accept the changes.
16. Governing law
These Terms are governed by the laws of the Republic of South Africa. Disputes will be heard by the courts of South Africa, without limiting any right you have as a consumer to bring a claim where you live.
17. General
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a right is not a waiver of it. These Terms, the Privacy Policy and the Affiliate Disclosure are the whole agreement between you and us about the Site.
